These Terms of Use (the “Terms”) are intended to govern access to and use of the website Fitness Center List (the “Site” or “Fitness Center List”), including all data, text, photographs, videos, messages, information, links, graphics or documents appearing on the Site (hereinafter referred to individually or collectively as the “Content”).

Your access to and use of the Site are subject to your acceptance of and compliance with these Terms, whether you are simply a user or have created an account (hereinafter referred to as an “Account”) and are therefore a registered user of the Site (hereinafter referred to as a “Member”).

Fitness Center List is neither the author nor the publisher of this information. As such, Fitness Center List is a technical Internet service provider within the meaning of European Community Directive 2000/31/EC of 8 June 2000 on electronic commerce.

Search Engine

Fitness Center List is a search engine for professionals that automatically indexes and references professional contact details that are publicly available on the Internet.

Referenced professionals have the right to control their information and may:

Create a Member Account to manage their professional listing directly from their Personal Area;
Request the modification or removal of their listing via the contact form;
Exercise their right to object to being referenced.

Fitness Center List undertakes to process requests for modification or removal within a reasonable period following verification of the professional’s identity. The requesting professional must provide evidence of their status and their right to act in relation to the listing concerned.

Fitness Center List reserves the right to refuse any request that does not meet the identity verification requirements or that is contrary to these Terms of Use.

Hosting

Fitness Center List also provides its Members with a Personal Area. Each Member may publish data, text, photographs, videos, messages, information, links and other Content in their Personal Area, under their sole responsibility. Each Member is solely responsible for the Content and use of their Personal Area.

In the event that a Member fails to comply with these Terms, Fitness Center List reserves the right to delete the relevant Personal Area or suspend the Member’s Account at any time and without any compensation.

In accordance with the provisions of the French Intellectual Property Code, by uploading Content to their Personal Area, the Member grants Fitness Center List a free-of-charge, non-exclusive licence to represent, reproduce, translate and adapt such Content associated with their Personal Area, for exploitation on websites operated by Fitness Center List and on Fitness Center List’s partner websites, for the entire duration of the statutory protection applicable to literary and artistic property rights and throughout the world.

Account Creation

In order to benefit from the Personal Area creation and hosting service, the user must create an Account on the Site in order to become a Member.

Each Account will be assigned a password enabling the Member who holds the Account to access the services of their Personal Area. The Member may change their Account password and username at any time and is responsible for maintaining their confidentiality.

Liability and Warranties

Fitness Center List reserves the right to suspend or interrupt the operation of the Site at any time, without being subject to any warranty, compensation and/or damages of any kind.

Furthermore, the user acknowledges being informed of the characteristics of the Internet network, and in particular that:

the transmission of data over the Internet is subject to a degree of unreliability due to the heterogeneous nature of networks and their various characteristics and capacities, which, when networks are congested, may affect download times and the accessibility of data;
the Internet is an open network.

Consequently, Fitness Center List cannot guarantee Members against the risks of intrusion, hacking of data, software or customer files, or contamination by computer viruses.

Fitness Center List shall not be held liable for any direct or indirect consequences or damages suffered by the user as a result of these characteristics.

Member Liability for Content Appearing in Their Personal Area

Fitness Center List is not responsible for the Content appearing in a Member’s Personal Area.

The Member acknowledges and agrees that they are solely responsible for the information, text, images, data, files, programmes and other Content appearing in their Personal Area.

The Member undertakes not to upload any Content:

that may infringe or be contrary to public order or accepted standards of morality, or that may be harmful to or unsuitable for minors;
that may in any way infringe the reputation, privacy or image rights of third parties;
that may infringe the intellectual property rights of any person;
containing a computer programme intended to damage or secretly intercept any computer system, data or personal information.

The Member shall indemnify and hold Fitness Center List harmless against any damage suffered by Fitness Center List and against any liability claim brought against Fitness Center List on the grounds of an infringement of any third party’s rights. To this end, the Member undertakes to pay directly, or reimburse Fitness Center List for, any amounts that Fitness Center List may be ordered to pay pursuant to a court decision or as part of a settlement.

Links to Other Websites

Certain links available on the Site may cause you to leave the Fitness Center List website.

The destination websites are not under the control of Fitness Center List, and Fitness Center List is not responsible for the content of such websites. Fitness Center List merely provides a title, thumbnail, link and short excerpt from the destination website’s page.

As a general rule, website operators do not object to websites creating links directing users to their pages. However, we provide website operators with the option to request that their websites no longer be referenced on our Site.

Intellectual Property

Fitness Center List exclusively owns the intellectual property rights relating to the structure of the Fitness Center List website, its presentation and the elements comprising it.

Site Pages

Fitness Center List does not own the articles, text, photographs, videos, documents or other Content available on the Site’s pages.

Fitness Center List does not own the copyright in the Content published on its Site.

Fitness Center List provides a hosting service for Personal Areas, which are the responsibility of the Members who created them. Content uploaded to the Site by Members, including images, text, documents and videos, remains the property of the Members.

Fitness Center List also operates a search engine that facilitates access to Content from referenced websites. As with any search engine, referenced Content is accessible through a direct link, and users must visit the publisher’s website to read such Content. However, we provide website operators with the option to request that their websites no longer be referenced on our Site. To stop being referenced on Fitness Center List, simply send us a message via our contact form.

Governing Law

The relationship between Fitness Center List and its users is governed by French law. Any correspondence relating to these Terms must be written in French.

Amendments

These Terms may be amended at any time. Users are therefore responsible for regularly reviewing them on the Site.
